Guidelines for R.A. 11032 also known as Ease of Doing Business

Implementing Rules and Regulations of R.A. 11032 becomes officially effective last August 04, 2019.

What is RA 11032 or EODB?

RA 11032 is also known as Ease of Doing Business and Effective Government Service Delivery Act of 2018. It is signed by the President last year to reduce the processing time in any government transactions.

Prescribed Processing Time

All government agencies, national or local, Government-Owned and Controlled Corporations (GOCCs), government instrumentalities located in the Philippines or abroad shall comply with prescribed processing time as follows:

  • 3 working days Simple Transactions
  • 7 working days Complex Transactions
  • 20 working days Highly Technical Application

Streamlined procedures for the issuance of local business licenses, clearances, permits or authorization

All government agencies, national or local, Government-Owned and Controlled Corporations (GOCCs), government instrumentalities located in the Philippines or abroad shall comply with prescribed processing time as follows:

  • Unified Business Application Form
  • Establishment of Business One-Stop Shop (BOSS)
  • Barangay clearances and permits are now issued at the city or municipality

Automatic approval

In case an agency fails to approve or disapprove an original application within the prescribed processing time, the said application shall be deemed approved.

CITIZEN’S CHARTER

All government agencies shall set up current and updated Citizen’s Charter to indicate in detail the:

  • – Checklist of requirements for each type of application or request
  • – Person/s responsible for each step.
  • – Amount of fees (if any).
  • – Procedure to obtain a particular service.
  • – Maximum time to complete the process.
  • – Procedure for filing complaints.

Special task Force for Fixers

Anti Red Tape Authority forms an Anti Fixer force to go after fixers preying on the public transacting in government agencies.

“Bumuo ang ARTA ng Special Task Force kasama ang ilang ahensiya ng gobyerno upang puksain ang mga fixer na talamak sa madaming ahensiya ng gobyerno.”

“Nanawagan ang ARTA sa mga pinuno ng mga ahensiya na linisin na ang kanilang mga bakuran at huwag nang hintayin ang ARTA na puntahan sila.”

“Ngayong epektibo na ang IRR, ganap na ang kapangyarihan ng ARTA na magpataw ng kaparusahan sa kung sinuman ang patuloy na magsusulong ng red tape sa gobyerno.”

ARTA said in a statement.

What are the penalties?

See what the penalties are for people who break the law.

No government officer or employee shall:

  1. a. Reject applications/request with complete requirements without valid reason
  2. b. Ask for extra requirements and charge fees not indicated in the Citizen’s Charter
  3. c. Fail to inform requesting party about the disapproval of application/request
  4. d. Fail to act within the prescribed time on the application/request without valid reason
  5. e. Fail to attend to applicants/requesting parties who are within premises of a government office before the end of official working hours and during lunchtime
  6. f. Fail to issue an official receipt
  7. g. Be involved in fixing activities in exchange of money or other benefits

Under ARTA, we will be implementing a 2 STRIKE policy for government officials and employees found in violation ofEODB/EDGSA:

FIRST OFFENSE: Administrative liability with six (6) months suspension. Except for fixing or collusion with fixers where the Revised Penal Code shall apply.

SECOND OFFENSE: Administrative and criminal liability

  • – Dismissal from the service
  • – Imprisonment of one (1) year to six (6) years
  • – Perpetual disqualification from holding public office
  • – Fine of not less than P500K
  • – Forfeiture of retirement benefits but not more than P2M

Any person who commits any act such as but not limited to bribery, extortion or malicious solicitation of favor shall be criminally liable and shall be punished under the Revised Penal Code and other special laws.
