Resignation vs Termination Philippines: Final Pay, Separation Pay and Employee Rights

Updated October 12, 2026. This NewsToGov guide explains resignation vs termination philippines: final pay, separation pay and employee rights for private-sector workers in the Philippines. Actual entitlements depend on applicable law, contracts and facts of the employment relationship.

Voluntary resignation

An employee who voluntarily resigns generally remains entitled to earned wages, proportionate 13th-month pay where covered, convertible leave benefits where applicable, and other contractual amounts. Statutory separation pay is not automatic.

Employer-initiated termination

Termination must rest on a lawful cause and appropriate due process. Authorized causes such as redundancy, retrenchment, and certain closures may trigger separation pay under the Labor Code. Just-cause dismissal generally does not carry statutory separation pay, although earned final-pay items remain due.

Final pay and certificate of employment

DOLE’s 2020 advisory provides a 30-day final-pay release guideline and a three-day period to issue a COE after request. These rules apply irrespective of whether employment ended through resignation or termination.

Practical comparison

Always distinguish the reason for leaving, legal entitlement to separation pay, and amounts already earned. Preserve notices, employment contract, payslips, and HR correspondence.
