Doble Plaka Law IRR Implementing Rules & Regulation

The Land Transportation office LTO releases the Implementing Rules and Regulation IRR of RA 11235 also known as Motorcycle Crime Prevention Act.

Commonly known as “Doble Plaka Law”, it is signed by President Duterte last March 28, 2019.

Implementing Rules and Regulation IRR of Doble Plaka Law

The IRR of Doble Plaka Law was signed by LTO Chief Edgar Galvante last May 11, 2020.

Registration by the owner

The initial registration of the motorcycle shall be made by the LTO by the owner or the dealer within five (5) days from the date of the sales invoice for brand new locally purchased motorcycles, or from
the Certificate of Stock Reported (CSR) report date for new or used
imported motorcycles.

Any sale or disposition thereafter shall be reported by the owner
to the LTO within three (3) days upon such sale/disposition, by
presenting an original copy and furnishing a machine copy of the
notarized Deed of Sale or similar document evidencing the
disposition of the motorcycle, to the LTO office where the latest
Certificate of Registration was issued.

Bigger, Readable, and color-coded number plates

Section 5 of the IRR tackles the new version of the number plates.

The LTO shall issue a bigger, readable and color coded number plate for every motorcycle. It shall bear a unique combination of alpha numeric characters.

It shall consist of the following:

a. metal number plate to be installed at the rear of the motorcycle with a size of 235mm in width and 135mm in height,
and made of the suitable and durable aluminum substrate material
with reflectorized background and security features. The font size for all alphanumeric characters is 60 mm tall.

b. a decal number plate to be displayed on its front. The decal plate shall be 135mm in width and 85mm in height, and made of suitable and durable sticker material with reflectorized alphanumeric characters and security features. The font size for all alphanumeric characters is 40mm tall.

Moreover, The contents of the number plates shall be readable from the front and the back of the motorcycle from a distance of at least fifteen
(15) meters from the motorcycle. For this purpose, all motorcycles
shall have a rear plate light.

For quick and easy identification, the following color scheme is
hereby adopted:
a.) Private Motorcycle – white background with color stripe and
black alphanumeric characters.

b.) Diplomatic Motorcycle- with white background and blue alphanumeric characters.

Penalties for violation

Failure to register or report sales or disposition within 5 days or immediately report its sale within 3 days

  • imprisonment of arresto mayor to prision correcional or a fine of not less than 20k but not more than 50k.

Driving without a number plate

  • a punishment of prision correcional or a fine not less than 50k but not more than 100k.

Failure of the owner to report loss number plate within 24 hours and failure to apply a replacement from the LTO(affidavit of loss must also be submitted within the next 72 hours.)

  • fine of not less than 20k but not more than 50k.

Erasing, Tampering, Forging, Imitating, Covering or
Concealing a Number Plate or Readable Number Plate and
Intentional Use Thereof

  • punishable by prision mayor as provided under the Revised Penal Code, or a fine of not less than Fifty thousand pesos (P50,000.00) but not more than One hundred thousand pesos (P100,000.00), or both.

Use of a Stolen Number Plate or Readable Number Plate

  • punished by prision mayor as provided under the Revised Penal Code, or a fine of not less than Fifty thousand pesos (P50,000.00) but not more than One hundred thousand pesos (Pl00,000.00), or both at the discretion of the court.

Meanwhile, enforcers are facing penalties as well if they fail to account for a seized motorcycle within 24 hours. They will be penalized with jail term of prision correccional that might come with administrative charges. Moreover, if there is cases of loss or damage under the custody of the officer, he will be held monetary liable for the full cost of the motorcycle unit.

When will the Doble Plaka Law be implemented?

The Land Transportation Office (LTO) Executive Director Romeo Vera Cruz in a statement said that the Doble Plaka Law will not be immediately implemented due to lack of number plates.

“Hindi pa po natin ito ma-implement kasi hindi pa po available ang mga plaka,” said Cruz, adding that no rider will be apprehended for nowbecause of the lack of a two-plate policy.
